Time Limit On Claims

Time Limit on Claims

Time Limit on Claims
A contractual deadline set out in a Canadian insurance policy that requires the policyholder to notify the insurer of a loss, accident, or event (such as theft, fire, or injury) and submit supporting documents like a proof of loss form. This limit ensures claims are filed promptly while details are fresh.

In Canada, notification is typically required "as soon as reasonably possible" (often within 24–30 days for auto claims or immediately for urgent cases), and formal proof of loss must usually be provided within 60–90 days of the loss, depending on the policy type (e.g., home, auto, or property) and provincial regulations.

Missing these deadlines can lead to claim denial, even if the claim is otherwise valid, though insurers may sometimes extend them for valid reasons like hospitalization.

Separate from provincial limitation periods (usually 2 years to sue the insurer), this policy-specific rule protects both parties by promoting timely investigations.
