Health Care Proxy

Definition


Health Care Proxy (Canada): A legal document, recognized by provincial/territorial law, in which an adult appoints a trusted individual to make personal, non-financial medical decisions on their behalf if they become mentally incapable of doing so themselves. The appointed proxy (also called a substitute decision-maker or medical power of attorney) gains authority to consent to or refuse treatments, access medical records, and speak with health professionals and insurers—always guided by the person’s known wishes, values, and best interests. Creation requirements (forms, witnessing, scope) vary by province/territory and must be completed while the person is mentally competent; the document has no effect on property or financial matters, which are handled under separate powers of attorney or insurance-beneficiary designations.
